Research project

Under the title Evaluation of the Law and the Ordinance on the Further Development of Skilled Labour Immigration, the Federal Office for Migration and Refugees (BAMF) and the Institute for Employment Research (IAB) are conducting research into the administrative implementation of the Law and the Ordinance on the Further Development of Skilled Labour Immigration (FEG 2.0). Within this framework, the research will examine the challenges posed by the administrative implementation of the law, particularly from the perspective of immigrants. In addition, the labour market integration of skilled workers and labourers who have recently immigrated will be analysed in greater detail.

A representative random sample will be surveyed. Immigrants holding residence titles for employment based on substantial practical professional experience (Section 19c (2) of the Residence Act (AufenthG) in conjunction with Section 6 of the Employment Regulation (BeschV)) and holders of an Opportunity Card (according to Section 20a AufenthG) will be contacted in full. Persons with a residence permit in accordance with Section 16d AufenthG will also be overproportionately included in the sample.

The invitation to participate in the survey will be sent by post to the respondents and will contain a link to the INGRESS online portal. The survey will then be conducted through INGRESS.

The online portal INGRESS is operated by Ingress GmbH, a service provider of the IAB. Ingress GmbH will handle the technical implementation of the survey through its online portal and pass the data collected in the survey on to the researchers at the IAB. With regard to data protection, the service is secured by an order processing agreement in accordance with Art. 28 GDPR; Ingress GmbH acts exclusively on the instructions of the IAB.

The BAMF is a higher federal authority within the remit of the Federal Ministry of the Interior (BMI) and a competence centre for migration and integration.

The IAB is part of the Federal Employment Agency (BA) and is tasked with labour market and occupational research, which the BA is legally obliged to carry out (Section 280 of the Third Book of the Social Code (SGB III)). In order to ensure the freedom of science and research as protected by the Basic Law (Grundgesetz), the IAB is separated from the administrative area of the BA in terms of location, organisation and personnel (Section 282 (5) SGB III).

Who is responsible for the survey within the meaning of data protection law?

The Federal Employment Agency (Regensburger Strasse 104, 90478 Nürnberg, represented by its Executive Board), as the body responsible for the IAB, is the controller in charge of the processing of personal data in the context of this survey.

Where did the BAMF and IAB obtain your contact details?

The IAB has received your contact details from the BAMF in strict compliance with data protection requirements, on the legal basis of Section 24a (6) of the Central Register of Foreigners Act (AZR-Gesetz) and, with your additional consent (to the prior transfer), may also use them to invite you to participate in this survey.

Your participation is voluntary!

The legal basis for your participation in the survey is your consent (Art. 6 (1) (a) GDPR), which is requested prior to participation. Your participation in the survey is voluntary. If you do not wish to participate, this will not result in any disadvantages for you. You can also leave individual questions unanswered or stop participating altogether.

The IAB holds administrative data relating to you, i.e. data from customer contexts and employer reports (e.g. periods of employment and unemployment). The administrative data is available to the IAB on the legal basis of Section 282 (5) and (6) of SGB III. Your answers in this survey are particularly useful to the researchers if they can be linked to your personal administrative data held by the IAB, as this improves the quality and informative value of the research results. Your consent to this linkage is voluntary and will also be requested.

Publication of the research results, deletion of your data

The research results will be published anonymously; no personal data relating to you can be derived from the published results.

The IAB will delete your contact details as soon as possible, i.e. after the letters have been sent, and will delete your answers and consent upon expiry of the retention period. This does not entail the deletion of your data at the BA and the job centres, as different statutory retention periods apply there.

It is planned to make the answer data sets available to other researchers via the BAMF Research Data Centre without the possibility of referring to a specific individual.

Your rights

Upon request, you may obtain information about your data that is held by the IAB and also have it checked to determine whether rectification, erasure, data portability or restriction of processing is required, and whether your objection to the processing has to be upheld. You may also withdraw your consent; however, the data processing carried out prior to withdrawal remains lawful.
