Determination of rights and duties in a modern welfare state
Abstract
"This article deals with the normative foundations of the welfare state and of labour market policy. Starting with fundamental questions of economic norms and social justice, the focus lies on reasons for social rights. The contractarian arguments of Rawls and Sen's concept of basis capabilities, which is based on Aristotle's concept of functionings, are used to establish social rights and duties. The rights of beneficiaries are discussed within the context of work. Finally, a form of reflexive activation of employable persons is postulated that considers the different abilities and possibilities of participation and that focuses on integration into competitive labour markets."
