Abstract

"In this article, results of a study examining the implementation of § 16e SGB II are presented. According to this law, an employer is entitled to a wage subsidy of up to 75 % for the employment of a formerly longterm unemployed person with multiple obstacles to placement. After a two-year period tenure of subsidized employment can be granted. Non-transitory subsidized public employment can be regarded as a reaction to the lack of market demand for a substantial part of the labour force as well as a novelty in labour market politics. Due to being contradictory to the activation paradigm of the SGB II the agencies in charge of implementing the law are facing an interpretative problem: Do they understand § 16e to be a 'Trojan horse'; questioning activating labour market politics or does it reinforce the paradigm quos validity? Furthermore, ways of integrating the implementation into varying regional conditions and practical routines of labour market actors have to be found. Active, quasi-entrepreneurial implementation is required which necessitates leeway, at the same time a possible means to obstruction. Therefore the implementation of § 16e SGB II proves to be particularly suitable for a model-like research examining the varying application of the given leeway, which can also be regarded as a crucial feature of the process of transformation of former administrative bureaucracies to modern service agencies."
