On the Draft Regulation for the Further Development of Skilled Labour Immigration. Statement of the IAB on the hearing of associations of the Federal Ministry of Labour and Social Affairs and the Federal Ministry of Interior and Community

Abstract

"The draft Regulation by the Federal Ministry of Labour and Social Affairs and the Federal Ministry of Interior and Community accompanies the draft Act on the Further Evolution of Skilled Labour Immigration in Germany. This statements comments on the draft Regulation in the context of the hearing of associations. The draft Regulation contains several measures, which increase inter alia the immigration of nursing assistants and short-time workers. These incremental changes are useful but will have presumably only limited quantitative impact. More import is that the draft Regulation allows workers with professional degrees obtained abroad, which are there acknowledged by the state, and work experience the immigration without further approval of their qualification if their earnings exceeds a threshold level. The threshold levels however exclude by and large skilled workers at the beginning of their professional careers. However, it is feasibly to deviate from the threshold levels if the companies are subject to collective bargaining. To increase the range of the new regulation, it would have been more appropriate to allow all companies to participate if the rules of the respective collective contracts are binding for immigrant workers irrespective of whether the company participates in collective bargaining itself. Furthermore, the so-called Western Balkan rule becomes permanent and its contingent is increased. This is economically useful, since the empirical evaluation of the rule delivers positive results."
