Befristete Arbeitsverträge begrenzen - Welche Folgen hat die Abschaffung sachgrundloser Befristungen?
Abstract
"In this statement, the IAB comments on petitions filed by the Social Democrat (SPD), Left (Die Linke) and Green (Bündnis 90/Die Grünen) parliamentary parties on the so-called 'ungrounded limitation' of employment relationships. Employers currently can hire personnel for a limited period of up to two years, without specifying reasons for limitation. The SPD faction proposes in its petition (document/Drucksache 17/1769) to abolish this possibility. The Left (Drucksache 18/1968) and Green (17/2922) factions join in this proposal. The two latter factions' petitions furthermore envision the abolishment of the legal possibility of 'limitation for screening purposes' for newly hired employees.<br> From a social political point of view, a further increase in the number of temporary employment contracts is indeed problematic, for the reasons given in the cited three petitions, and limiting their number is generally desirable. The legislator should, however, verify whether an abolishment of ungrounded limitations can actually contribute to reducing the number of temporary employment relationships, in how far restricting employers' freedom of contracting is legitimate, and if abolishment could induce decline in employment."
